Abstract : The value of free speech comes from the constitutional protection, and the way of providing this right within the constitutional framework. The American Constitution has protected this right in an absolute language, which restricts the government to not impose any limitations on the right of freedom of speech, unless with having a compelling governmental interest. In comparison with the U.S., the Iraqi Constitution has restricted freedom of speech, which allows the government to put limitations on this fundamental right. Consequently, a number of legislationhas been adopted in Iraq in a way that conflicted with free speech. Hence, for returning the value of free speech, such those legislations must be changed under the current international principles.
