The Arbitrator’s Procedural Powers in Arbitration Preparation

Abstract
Abstract - The arbitrator shall be granted powers to assist him in carrying out the arbitration process, and these powers are derived from the provisions of domestic law, and international law of UNCITRAL. The arbitrator’s powers are determined by two basic issues: “the arbitration agreement and the law.” The law and the agreement may limit the arbitrator’s powers, or grant him broad powers, and the arbitrator must abide by the limits set by the law and the agreement. The arbitrator is appointed by the parties to the dispute, the court or Arbitration Center, and the authorities granted to him facilitate the settlement of the dispute. These powers are either exercised by the arbitrator before the arbitral proceedings, or he exercises them during the arbitral proceedings.
