Abstract : This article aims to explore the problems of enjoyment of human right to clean and healthy environment in Kazakhstan. The objects of the research - to emphasize main problems of enjoyment of human right to clean and healthy environment in Kazakhstan; to analyze the world best practice; to make the legal evaluation to legislation of the Republic of Kazakhstan and legal practice; to elaborate the concrete proposals for overcoming of shortcomings connected with enjoyment of human right to clean and healthy environment in Kazakhstan. In the scope of this work the following problems were analyzed: - absence of an effective governmental policy aimed at restoring of polluted environment; - absence of an effective system for processing and recycling of waste; - low ecological culture of citizens; - lack of equal access to environmental information; - weak liability for environmental offences. In our opinion, all of the abovementioned negatively impact on the enjoyment of human right to clean and healthy environment in Kazakhstan at the proper level. The methodology of the research consists of application the methods of comprehensive knowledge, analysis, synthesis and method of comparison. Our proposals: - to amend the environmental legislation of the Republic of Kazakhstan with focus on systemic restoration of polluted environment; - to stimulate the usage of renewable energy sources; - to tighten legal liability for environmental offences and failure to recycle industrial and household waste; - to pay attention for improving of environmental culture of the citizens of Kazakhstan; - to amend the Land Code and the Environmental Code with covering the issues of effective environmental management.
